Licensure
CTeL has a long history of highlighting licensure as a barrier to telehealth. In 1998, CTeL's general counsel, Bob Waters, worked with the National Council of State Boards of Nursing (NCSBN) on the creation and implementation of the Nurse Licensure Compact, a mutual recognition model of nursing regulation. The Compact provides a multi-state license for nurses residing in a Compact State. The RN and LPN/VN Compact began January 1, 2000. The first evaluation of the Compact was completed in December 2003 and demonstrated the Compact's many successes. CTeL strongly supports the innovation created by the Nurse Licensure Compact. In December 2003, under contract to HRSA's Office for the Advancement of Telehealth, CTeL convened a group of key stakeholders in the area of telehealth and licensure for the purpose of developing potential licensure policies that protect the public, but do not inhibit access to telehealth services unnecessarily. During the meeting, "Telehealth and Health Professions Licensure: Creative Solutions for Today and Tomorrow" the stakeholders discussed possible solutions around three primary areas:
- Multi-state Licensure Options
- Consultation Exceptions
- Physical Examination Requirements
Bob Waters was honored by NCSBN for his leadership and "outstanding contributions to the development of new model of nursing regulation for the 21st century, the Nurse Licensure Compact 2004."

Another dimension of regulatory concern, emerging primarily from questions about medical practice over the Internet, is the establishment of a valid physician patient relationship. Some states require that the physician perform a physical examination prior to ordering medication or otherwise treating patients. This map provides an overview of state actions related to the requirement for a physical examination.
